A.Ibrahimkutty vs The District Registrar (General)

The case featured a man and his 2 two daughters, suing the state department of land revenue claiming that their familial arrangement with respect to the property should be recognized as a partition deed and registered without any additional conveyance costs. The court ruled in favour of the family noting that the system of Maramakkathayam had been instutionalised by legal sanctions and as such a familial arrangement of property may even be oral making registration. It also noted an important precedent set by a 1955 case in the Supreme Court.
