The case chiefly concerns itself with the rules of property partition within the tavazhi. The petitioners, now from 3 divided tavazhis, appealed a lower court decision that claimed that their initial partition was improper because the division was per capita and should have been per stirpes. The high court verdict noted that there was no rigid rule in favour of either method and there was the existing practice of the per capita basis division in several Marumakkathayam tarwards. The appeal was granted in favour of the petitioners
