This was a second appeal against a 2006 judgement issued by the district judge in Kozikhode. The petitioner claimed to be entitled to a share in coparcenary property based on an amendment to the Hindu Succession Act in 2005 that made daughters coparcerners at birth equal in rights to male heirs. The chief contention here was whether amendments to Section 6 of the Hindu Succession Act and the provisions of Kerala Joint Hindu Family System Abolition act of 1975 would even apply to the disputed property. The verdict decided that the disputed property ceased to be coparcenary as soon as the abolition act took effect in 1976 and dismissed the appeal.
