Ponthinoda Sainabi And Ors. Etc. vs Vatakkiloda Aboobackerkoya And

 | 2001

The case involves appeals filed against lower court judgements on the matter of recovery of the possession of disputed property. In the previous judgment the right to file a fresh suit for partition was upheld in the light of finding that all the necessary parties were not appropriately consulted. The High Court accepts the pleas, finding the properties in question to be self acquired, not available for partition and the petitioners entitled to reverse disputed properties in accordance with Muslim Personal Law.
